It was reported a few days ago that President Obama was meeting secretly with America’s top mayors to announce executive action on gun control. According to Kristin Tate, one of our reporters, “As you may remember, Obama failed to pass gun control measures through the Senate last spring. Most notably, the president was pushing for background checks for gun purchases.”

Today Obama made good on his promise to push for more gun control.

Rather than wait for Congress to pass new laws Obama bypassed them today. The two executive orders were announced at the same time the new Alcohol, Tobacco, and Firearms (ATF) director Todd Jones was sworn in. Jones has been upheld by Senate republicans until recently. The ATF will be the enforcer of Obama’s two new executive orders.

The first order seeks to close a loophole, which allows felons and others who would be otherwise prohibited from owning firearms to bypass the law by registering their firearms with a trust or corporation. This would exempt them from having to complete a background check. It also forces anyone associated with a trust or corporation to complete a background.

The second order signed by Obama seeks to prohibit military-grade weapons from entering into America by keeping private entities from re-importing guns that the US previously sent to foreign allies. Currently, a law already requires U.S. government approval before these weapons can be re-imported. The White House says that more than 250,000 weapons have been brought back to America since 2005. Under the new executive order this practice will no longer be allowed. The weapons sent to foreign countries will have to remain there.

    Obama has made yet amother treasonistic action by by-passing congress. His Executive orders are not laws. America needs to wake up and read the Constitution of the United States. Every Ex-ecutive order he has wrote unless made into law by Congress is worth its wait in toilet paper. Obama is pushing for a Civil War here and a World War so that while our military is fighting overseas we can be taken over by Muslims and he can reign as a dictator. The time to IMPEach this Marxist Muslim is now. If the Congress don’t do it the people will have to rise up and do it themselves. The March on Washington Sept. ( 2013 Should not have to be. On its first day back from Vacation Congress needs to overrule all executive orders and Obamacare pending the results of Impeachment proceedings against Barack Obama, Joe Biden, The whole Obama Administration, Nancy Palosi, Harry reed and John Boehner. Then a new Emergency election for Speaker of the house should be held annd a new election for President and Vice President be Scheduled for 2014 elections.       Ok. So the biggest problem here is that he acted illegally. Fortunately, these laws seem to make a lot of sense (not that we have any legal binding now on the president or congress’s sense of justice). Now we need to fix about everything else in the system, our corrupt president/congress. It’s not just Obama. It’s not just Bush. It’s not RED vs BLUE. WE need accountable government officials at all levels, but especially in Congress and and White House. We can bitch about it all we want, but really, we need to start asking the question “How can we affect change in our country for the better, and how can we get people to be involved”. All of us reading this know this has to be down. How do we do it is the real question.

        It makes a lot of sense to prohibit M1s from being imported BACK into the country? They already do not import anything that is fully automatic (or even burst fire), which eliminates ll those “evil” black rifles. The most modern rifle this all affect is the occasional M14 that is semi only.

        And I am sure the number of criminals setting up Firearms Trusts rather than just buying from associates is substantial and the cause of much violent crime. (/sarcasm)

    When Obama/Soetoro/whatever-his-name-is is officially found guilty of impersonating a natural-born citizen, all of the executive orders and bills he signed into law will be null and void.

    To this end, it is important that Obama is *not* removed from office by standard impeachment proceedings but instead indicted on criminal charges, including specifically the charge that he committed high treason by pretending to be eligible for office.

    Executive orders are only to be used sparingly and when in dire need. It is a violation of the Constitution for this usurper to legislate through executive orders. It is Congress’s job to make law, not for it to be ordered like a dictator.

      The executive branch seems to have been given a pass by the majority of congress to do pretty much whatever they want and never mind if it is constitutional.

      Executive Orders have always existed; but their purpose is to pass orders to the Executive Branch. They do not carry the force of law outside of the police, FBI, CIA, NSA, Military, etc.

      The first order enforces a current law (that felons cannot own firearms). The second order pretty much just states that the approval that used to be required for re-importing guns will no longer be granted. Neither are new laws.

      Oh please, the law that puts restrictions on the right to own firearms is in and of itself against the law, there is no lawful case that has been tested at the Supreme court level that supports the idea of “but” on the 2nd amendment. The only law I would support that restricts firearms to anyone is if they have ever been used during the commission of a crime, even then, their has to be available relief. Someone who commits a felony, who has the opportunity to get their record expunged has a chance at relief thus their rights recognized… Someone who is restricted from firearms should have the same opportunity at relief regardless of the road they traveled..

      They should have to prove to the community they reside in they are not a threat to them. You cant just say no matter what people cant defend themselves or their families or property because they made a bad choice, which more so than not, is a reflection of their upbringing.

      Attack guns and criminals sure, but at least do it in a way that has substance. People who have done their time should have relief. You want to really reduce crime and create a better atmosphere for children, education education education. And if you stop trying to beat the people at the law maybe the people wouldnt try to beat you at it… Wait, that is where your cash comes from, there has to be criminals and degenerates, in fact you want our entire society to be full of degenerates where everyone is classified a criminal. We would be disarmed, and you would have the ability to take what you want from whomever you want, whenever you want.. At least today you have to consider the blowback of your choices against the largest army in the world, the people of these united states, and their constitution.

    For once Obama is being transparent. He does not want the AK-47’s to be shipped to the USA because then his brothers in the middle east would not be able to acquire those weapons. The imports that come into the USA by and large are long rifles such as the Mosin Nagant and the AK-47. Very few pistols are imported and those that are mainly are collector pieces. They are not the Saturday night specials or the semi-auto pistols for the most part. Obama has shown his hand on this one. He has to do this to support his Al Qaeda friends. As to the other order regarding registration through corporations and trusts, it will not have one bit of effect on crime. The criminals are not registering their weapons. THEY ARE STEALING THEM. But I guess that fact is over Barry’s head.

      Licensed professionals such as lawyers, doctors, etc, have to pay to renew their licenses in order to continue to practice legally. Why shouldn’t you have to pay a yearly license fee to keep your guns legal? Why would you object to it if what you are doing, by owning the guns, is legal?

        Because that amounts to levying a tax on a right. It’s like making me pay a fee in order to get a license to print a newspaper, peacefully protest, vote, not be randomly strip searched, have my case go in front of a jury, or any of the other rights that I enjoy as an American.

        By contrast, you do not have a “right” to be a lawyer, nor a doctor. You have a right to pursue those careers; but not an inalienable right to BE one.

    The responses here are laughable. Not a damn thing about these orders is illegal. The first is closing a loophole in order to enforce a law that already stands (felons are prohibited from owning firearms). The second pretty much says that the approval that used to be required to bring these guns back from overseas will no longer be given. This isn’t legislating and it does NOT overstep the bounds allowed by executive order.

      Where as they are not illegal, neither do they apply to the American people. Yes they do overstep. Executive Orders are used to enforce various agencies in the federal government. They do not give the President the right to “make” new laws and usurp the role of Congress or the individual states. There is a reason for the separation of powers, and it is to prevent tyranny such as this.

      I don’t think you understand the separation of powers. Executive Orders are orders that apply to the Executive Branch. Currently, the EO being given is an order to enforce laws that do not exist. Violating them carries no penalty, other than illegal prosecution by Police, ATF, etc.

        Like I said before, these are not new laws. The law that prevented felons from registering firearms already existed. The law requiring approval for re-importing guns already existed.

          As it turns out, the SCOTUS already ruled that it’s unconstitutional to force people who are not allowed to own firearms to register them. It violates their 5th Amendment, by forcing them to admit they were breaking the law… and as such, this executive order does nothing. The second EO also doesn’t do a whole lot.

          Though, the question must be asked: “If these are all pre-existing laws, then why does the President need to sign an EO to force his branch to do what they’re supposed to be doing, anyways?”

      A lot of collectors’ items were sent to other countries that we should be allowed to import back here due to their rare availability. There are currently many U.S. made WWII era M1 Carbines and Garands that collectors would like to purchase held up in S. Korea.

      Since when is the BATF or any domestic civil police force under the cabinet authority of the Executive branch. The BATF is under the jurisdiction of Congress, otherwise we have a dictatorship.

    It’s illegal to deny people who have been convicted of felonies their second amendment rights once they have paid their debt to society.
    This is where it all gets started. Denying people their rights for one reason or another.
    The KKK was behind some of the first gun control laws to prevent freed slaves from having the right to bear arms.
    Some of you people claim to be pro-second amendment but seem to think it’s okay to deny people convicted of a felony.

        Not in all states. My state, Missouri which is a very pro gun state, has no way for convicted felons to regain thier 2A rights. Even after they have paid thier full debt to society. Bottom line, if you are dangerous enough to not be trusted with your right to self protection, then you should be locked up away from society. If you have been declared by your states department of corrections to be safe enough to live in society, then you should have the right to defend yourself and your family.

            Owning a gun protects your right to life and your liberty. The 2nd Amendment uses the word “arms”, which (at the time of it’s drafting) meant “man-portable weapons and armor.”

            In other words, you have a god-given right to keep and carry things like:

            – A bullet-proof vest
            – Pepper Spray
            – A pocket knife

            Or any myriad of things that can be used to protect your life and your liberty… including firearms. After all, you can have all the rights in the world; but without the means to protect them, they are moot.

            Our nation’s highest laws outline certain ones that are to be respected and protected at all times; and the right to have weapons to defend yourself and your country is one of them.

    Honestly I am torn. As a registered Libertarian I am all for Civil Liberties but I believe gun proponents who abhor more “gun control” are being overly paranoid. Where is the line drawn? Should you or your neighbor have in or her “legal” possession any and all types of weapons? Where do we as a society draw the line between individual Liberties and public safety? An age old question that is debated more today than ever before.

    My issue is President Obama and his blatant arrogance by thumbing his nose at the supreme law of the land, the U.S. Constitution. In more areas than Personal ownership of guns.       Just think of all the people that may be killed in a civil war if they come for the guns.

But this screwed up government wants to take away all guns so, supposedly, the crooked element won’t be able to get their hands on guns. But even they know better than this. They know there will always be guns for the crooked element to use in their crimes. The lesser crooked element does not bother them. But the armed law abiding American citizen does to the tune that they will lie, cheat and threaten to get as many gun laws passed as possible so the law abiding citizen who believe in our constitution can’t stand up for it.

      There are millions of men in prison on frivolous drug charges who are serving time for doing the drugs that the CIA brings in – absolutely criminal. It’s a deliberate attempt to strip men of their rights by making them felons.

      Men are being singled out to be disenfranchised, second class citizens, without any rights.

        I don’t know. I get the impression that they do this to women, but mostly the docile ones. The whole system is like that. Cram a bunch of crazy killers together and nobody wants to be a guard, the warden has trouble keeping order etc. But lock up a bunch of non-violent offenders and you’re looking at guys that are more likely to play cards than fight. Each one gets the prison system $48,000/year of taxpayer dollars to imprison. The docile ones cost less so there’s incentive to release the violent offenders and chase(/create) non-violent ones.

        I read a few years back about a single mother in Oklahoma that was sentenced to 10 years for selling $35 worth of grass. This means that a shameless, soul-less cop was paid to run around levying war on the people and when he found a single-mom with $35 worth of a plant, the Oklahoma prison system decided it can get $480,000 for taking her freedom and they did.

            The SCOTUS ruled that it’s illegal to make criminals register their firearms. The only legitimate use of a gun registry is moot, because the people it’s meant to stop are legally exempt from that law under the 5th Amendment.

    Under existing law, allowing a felon to possess a firearm is illegal. By adding a felon to a trust, the executor of the trust is already committing a crime, punishable under current law. This “action” is based solely on hypotheticals. Why would a felon bother with trying to find someone with a clean record to create a trust, then have that person undergo a background check, when it is far easier to buy a stolen gun?

    Felons in possession of firearms is already illegal, so it is a fear tactic to say that there is a “loophole” that allows them to buy a gun this way. The reality is that this doesn’t happen.

    I challenge anyone to provide a single documented case of a felon getting and using a gun via the method described above.

      We’ve effectively had executive orders since the days of George Washington. Modern executive orders must also fall under the scope of specific laws, which are to be cited in the order, and not create new laws. I suppose whether or not the actions defined under an EO are actually within the scope of said laws is another story.

      In any case exec orders are not something new, by any stretch.

        There is nothing inherently illegal or unconstitutional about EOs. At it’s core, an EO is just an instruction to the Executive Branch, and carries no weight of law outside of that chain of command. It isn’t until you try to use them as a replacement for law that problems arise.

        The president does NOT see that they’re enforced, actually. The Judicial branch makes sure they’re enforced. They’re called the Supreme Court because they are the highest court of authority. The President (or Executive branch) signs the laws into effect those which were proposed by the Legislative branch. Have you learned nothing in any Political Science or US History class?

    The executive order has been ridiculously abused for over a hundred years. Laws are passed by Congress. The executive order was designed so the president could spend a small discretionary budget for items such as White House drapes, dishes, and office furniture. A president is not a king and cannot issue orders in lieu of congressional legislation. To the extent we allow this, we are complicit in the tyranny that is destroying our country.

    On April 5th, 1933, Franklin D. Roosevelt issued an executive order confiscating gold in the possession of US citizens. We never should have let that stand, but the bankers had us by the short hairs. It’s all been downhill since then.

            Someone, who could afford to pay for expensive lawyers, challenged the concealed carry law in Illinois and it was overturned, by the Supreme Court. So, I guess your statement that none has been overturned, is not true. The situation is not a laughing matter. Making generalize statements shows the lack of detailed information you have. I am also glad that laws about having slaves were overturned and that the segregation in thee country has stopped. I feel the same about the courts taking the sodomy laws off the books, reversing the laws to get the government out of our personal lives. Bad laws are still bad laws, even if they are still on the books in some states. Being poor is a bad condition in the US because the law is only afforded to be manipulated by the rich, unless one gets financial backing from organizations like the ACLU..

        @Andrew, it is not about loopholes or criminals. A lot of law abiding citizens use trusts and corporations to buy sell and trade arms. One example is, if I want to pass my collection to my grandson without the hassle of probate court or deal with property taxes or estate taxes etc. the best way to do so might be for me to set up a trust through which he can become the legal owner of my collection without issue. Obama’s ruling is about non-criminals or confiscation in violation of the second amendment to the Constitution if you will. It is not nor has it ever been about criminals and crime prevention.

And the GRAND FINALE: a central bank that can control the money supply which stabilizes the fluctuating nature of the economy thereby stabilizing the economy and ensuring robust economic development vs. a group of bankers who were sick of being lynched for loaning more money then they had in the vaults setting the stage for bank runs who decided to put the federal government on the hook and therefore the tax payers for any mischief they create in the economy such as the great depression and other depressions actually created by the speculation and bubbles created by cheap money and lower then market value interest rates while they bail out their friends with YOUR and MY MONEY!!!!! And at the same time get the added benefit of owning and controlling our politicians except for the few (Ron Paul, Justin Amash, Dennis Kucinich) who are able to get elected despite the massive amounts of money and control. How about an executive order stating that NO Govt agency or its dept heads can propose an operation which FORCE its agents, employees, or other govt entitys to BREAK ANY STANDING GUN LAWS that exists, NOR can they be immune to prosecution for caring out such actions that violate the Constitution, its Amendments, or any Bill of Rights.         For Obama OR the Congress to impede or infringe in any way in Americans the right to bear arms is against the Constitution. Obama in his executive orders that he keeps writing to DICTATE to Americans what we can and cannot do. These executive orders are a part of what is called “delegated powers” of the presidency. Powers that are allowed or not protested by Congress because they are usual a means of strenthening certain administrative policies or procedures which in a special or time limited situation needs to be further clarified in the details…. NOT a dictation of orders that out an out take action FORBIDDEN by the very CONSTITUTION of what limits the govt (includes all branches) from intruding on the rights of its citizens.

He closed a loophole and stopped people from bringing guns designed for war back to the US and putting them in the hands of citizens or crimimals… now that being said he went about it in a terrible manor and one that is a very slippery slope you shouldn’t be angery about the contents but rather the method used to put those laws on the books… I want everyone to ask thems selves “in order to protect my self from thieves or intruders do I need 20+ bullets and a high powered rifle to do that?” If I takes you more than 5 or 6 shots to hit someone who broke into your home… then you dont need a gun because you cant use it effectively

      I’m not necessarily upset with what he changed; he closed loopholes, and I can agree that it may be a good loophole to have closed. However, the method in which he has done so is not acceptable. While it seems as if this issue is of high priority to Obama and to many Americans, it is certainly not justifiable to circumnavigate Congress to do so. Not in this situation. This is not a time sensitive, issue nor is it one that is immediately demanding attention. Abuse of power is abuse of power.

Autos that were not registered before 1986 cannot be privately possessed anyhow.
      As for the “trust or corporation loophole”, what is being done is making one individual be registered as the sole owner/legal possessor instead of a group of people being able to co-own or multiple descendants from inheriting a National Firearm Act controlled item (aka. automatic weapon, suppressor, short barreled weapon). People found a way to reduce the amount of tax they had to pay, and Obama now wants to make the $200 tax stamp and registration process redone each time someone dies. I’d like to see the BATFE admit they actually let the type of people Biden just claimed posses these restricted items legally have them.

    Think about this: A juvenile that was in and out of mental health facilities, diagnosed bi-polar, and had a court record that included assault is now in the military. As a youth, he was placed in a facility for wayward teens because he was in constant trouble, while there he made a “fire bomb” and was charged in juvenile court with making a device designed to start a fire, cause harm to others, etc. Late into his teens, he had assault charges, contributing to the delinquency of minors, and destruction of government property (sprinklers@jail). This young man somehow got into the military!! He couldn’t have told the truth on his applications, so didn’t they check his background, or were his juvenile records exempt? Also, he was diagnosed bi-polar while in college, but he wouldn’t take the medications, so he left school. In the past 5 years, he’s been married, assaulted his last girlfriend, and drinks far too frequently for someone that has a background such as his and has been diagnosed with bi-polar. Guess what he does in the military? He fires missile! And we’re worried about people carrying pistols.

      As for the “trust or corporation loophole”, what is being done is making one individual be registered as the sole owner/legal possessor instead of a group of people being able to co-own or multiple descendants from inheriting a National Firearm Act controlled item (aka. automatic weapon, suppressor, short barreled weapon). People found a way to reduce the amount of tax they had to pay, and Obama now wants to make the $200 tax stamp and registration process redone each time someone dies. I’d like to see the BATFE admit they actually let the type of people Biden just claimed posses these restricted items legally have them.

    The article is misleading.

    First, the trust registration only works with NFA items. These items are extremely difficult to legally obtain, requiring a good amount of paperwork, a $200 tax stamp per item, and close to a year of waiting for the ATF to process the paperwork.

    You still have to fill out other forms when making the initial NFA item purchase, which include a background check. The same background check you get if you buy a non-NFA regulated firearm (read: the guns you see in your local gun store). There is no “loophole” to be found here. At all.

    The whole point of trusts was to create legal protection for spouses or family. If I owned a legally registered NFA item (I don’t, too expensive for me), and I died…. the ATF would charge my wife with illegally possessing an NFA item, which is a felony. Even if it never left my safe and she called them to collect it post-my demise. With a trust, you can register multiple people, and create that legal protection so your family isn’t charged with a felony if you die.

    Second point: This is deliberately misleading the non-gun owning population. What this article fails to mention about the allegedly “military grade” firearms not being allowed back in to the country are 60+ years old or older, are mostly bought by people with an interest in history, and have always been perfectly legal to own in the United States. They don’t even fit the description of the proposed “assault weapons ban” that Obama, Feinstein, and other Democrats pushed so hard for and failed to achieve. They don’t fit the Clinton-era AWB either.

    Oh, and most of them are bolt-action rifles… just like millions of hunting rifles in your grandfather’s gun cabinet.

      I believe a Trust Company also allows you to pass that weapon down to your children in the event of death (please someone correct me if I’m wrong). Otherwise the weapon suddenly becomes nobodies and illegal for anyone to possess.

      I’d love to hear from anybody about one of these particular weapons ever being used in a violent crime.

      Fully auto weapons of this category START at around ~$15,000 US. Find me a criminal who can afford one or someone willing to sell one for less. This “law” is a solution to a non-problem and serves no purpose but to spit into the face of the gun owning and freedom cherishing public.

    The President is Under Article II of the Constitution, (the President) is responsible for the execution and enforcement of the laws created by Congress. The president has no power to create laws. He has overstepped his power. The Supreme Court, however, put a stop to this (boundaries regarding Presidential Executive Orders) in 1952 when they were faced with the case Youngstown Sheet & Tube Co. vs Sawyer. In this case, the Supreme Court ruled Harry Truman’s Executive Order 10340 which put all steel mills in the country under federal government control. The Supreme Court called this executive order invalid because it attempted to make law, which was the job of the legislative branch (Senate and House of Representatives). Since then executive orders pertaining to laws were only allowed to be carried out when they are used to clarify or act to further a law put forth by the Congress or the Constitution.
    It’s time for our country to start challenging these illegal Executive Orders.

    As a FFL holder, and a owner of a corporation; I can tell you this, laws were passed to allow corporations to exists as an entity of its own, with the same rights and privileges as you and I, legally a corporation can buy/sell property, posses firearms and any legal item an individual can have.

    All property is in the name of the corporation, not any one individual, but any officer of the corporation can use any property held by the corporation, there’s the loophole, meaning if you were a felon and were an officer of a corporation who owned firearms, you would have access to the firearms, and if your corporation were incorporated in a state that allows the officers to remain annyomous, then you have indeed used the loophole, to me you would not have violated any law, other than A felon with a firearm, but the loophole is legal, as congress not you or I wrote the law, but failed to clairify it.

    On the part of the NFA items, these are legal in some states, and yes if you live in a state that allows you to have a .50cal, then all that required is for you to go to yor FFL fill out the paperwork, he submits it to the ATF along with the one time $200.00 fee, you wait roughly six months for approval/denial from ATF, if approved your FFL is notified, he will notify you, you show up and pay the remaking fees and finish any required paperwork and you are on your way.

    Your FFL has to have the proper type license before he can engage in NFA firearms, it requires register action with the state department and and annual fee or around $2500.00, and is why most FFL holders do not engage in these types of firearms.

      There isn’t anything inherently unconstitutional about an Executive Order. It’s just a formal order that is passed down to the Executive Branch, generally in the form of restrictions; and usually, these orders are drafted in such a way as to reflect a *policy.*

      For example: EO 12333 establishes limits and procedures on the US intelligence community, including (but not limited to): the prohibition of intelligence collection against US citizens, unless it is the authorized mission of that unit (I.E., the FBI, Police, etc.); and the mandate of sharing of information between intelligence agencies (CIA, FBI, NSA, Military, etc.) to prevent the duplication of effort, and therefore the waste of tax money.

      Unfortunately, sometimes EOs are drafted in response to a law not being passed… and that’s when we see things like the above.

            What the order says: Issued two months after the
            invasion of Iraq, this order offers broad legal protection for U.S.
            corporations dealing in Iraqi oil. Bush’s directive, justified as a
            means of protecting Iraqi oil profits, nullifies any sort of judicial
            proceedings relating to either Iraqi petroleum or the newly created Development Fund for Iraq.

            I didn’t see anything about gun trusts requiring a background check; but a lack of evidence is not synonymous with being wrong, so I’ll assume you got that elsewhere. Based on my own research, it would be wise for the owner of the trust to perform a background check, but I saw nothing to suggest that a background check was required to use a gun trust, since all of the guns seem to belong to the owner of the trust.

            1) “NFA items owned by trusts are legal possessions of the Trustee (or Trustees if more than one Trustee is serving). Each Trustee may use the firearm as well as any beneficiary in the presence or under the authority of the Trustee. Be sure to not cause an ‘accidental felony’ by naming a beneficiary who is legally not allowed to use, possess or own a firearm.”

            What I did see in your article, however, is several instances of reporting by the A.T.F. and the NY Times that gun trusts do not require you to run a background check, and are actually specifically exempt from background checks on all of the forms.

            From that article you posted:

            1) “… most gun dealers continue to require background checks for the representative of the trust who picks up the firearm. But not all do.”

            2) “Mr. Campbell [, a spokesman for the A.T.F.,] confirmed that under current regulations, background checks were not required for the buying of restricted firearms through trusts.”

            3) “The A.T.F.’s regulations, in fact, exempt trusts from background checks, as noted in the Federal Firearms Regulations Reference Guide.”

            4) “Many dealers conduct checks anyway. But others take the government at its word. One dealer, for example, said he did not think he had to run background checks for sales to trusts because Form 4473, the record of the transaction filled out by the dealer and the customer and sent to the A.T.F., specifically lists trust transfers of restricted firearms as an exception to the requirement for background checks.”

            However, those sources also explain that the EO created a new restriction by imposing background checks on people for associating with NFA Trusts. Rewriting the regulation to state “the representative of the trust, picking up the weapon, will be subject to a background check” makes sense, and is legal.

            Requiring a background check on the owner of the trust (since all the guns belong to them) and running THAT background check, and treating all of the beneficiaries as “borrowers” makes sense, since that’s the concept behind what’s going on. However, requiring people to complete background checks simply for being associated with these trusts (which is what I’m reading) creates a NEW restriction; not tightening an already existing one. This is, specifically, what I believe is overstepping the bounds of Executive power and into the realm of legislation… and why I take issue with this.

            As a side note: The article (and my independent research, cited above) explained that criminals have a disincentive to use a gun trust, because it’s actually cheaper and faster to buy these guns illegally… and it isn’t reported to the A.T.F. and doesn’t leave a paper-trail. It’s pretty clear that everyone (A.T.F., news agencies, executive branch, etc.) knows that this will do very little to stop crime, but will do a whole lot to stop the legal ownership of NFA firearms.

    I worry that the exec order, while seemingly innocuous because hardly any weapons are affected and little opposition is likely to occur, will be a precedent setter for further actions and exec orders that will affect gun owners. That’s how you get what you want against opposition. You never see the solution as a single step, rather, as a series of steps toward a goal. That’s how our tax system has grown beyond any rational dimension. Notice that the announcement coincided with the congressional recess and the Labor Day Holiday…… Slides right by with hardly a mention.

        Yes…Orbitus…most presidents have used Executive Orders during their presidency. However, the fact that Obama has enforced more Executive Orders than ALL PREVIOUS PRESIDENTS COMBINED is a pretty big indicator that he is nothing more than a petulant man-child determined to have his way… any means necessary.

    The first EO does nothing. A trust must list the trustees, all of whom must pass a background check through NICS. If a trustee permits access by a prohibited person, he is committing a felony and can be arrested.

    The second EO is unlawful under current US law, so I expect lawsuits over it. We should see arrests of any US government employee who attempts to enforce it, but we are unlikely to see such a wonderful thing.

    And on January 16th 2013, surrounded by children, he has signed twenty three different executive orders for broader gun control in the United States.

    Mr. obama is the biggest mistake this country has produced.

    political commentator and adviser you may like to know that presidential executive
    orders only pertain to those in the executive branch, not to the Legislative
    Branch, not to the Judicial Branch of government and certainly not to the rest
    of the people. This is similar to Burger King CEO giving an executive order. It
    only applies to Burger King. The people have the right to do anything with any
    arm (usually a firearm) they please as long as they do not injure or cause a
    loss to another. The supreme law of the land, the Constitution, protects that
    right. Read 2nd amendment.

    “The right of the people to keep and bear arms, shall not be infringed”
    is protected. Public servants take an
    oath to protect and defend that Constitution. Any interference contrary to the
    plain meaning by a public servant is fraud on his/her part and a felony.

      The 2nd amendment isn’t impervious to regulation. Just like any other amendment. Just take a look at this: . There has been laws made and passed since the creation of the 2nd amendment and almost all of them are still on the books. Most notably the NFA of 1934 and the Gun Control act of 1968. Then you also have the Brady Bill that stops you from getting guns on the day of purchase for a handgun. Some of you people nowadays need to actually read some laws before foaming at the mouth thinking that it impedes on your freedom.

            While I respect and honor their decision, the 2nd Amendment is crystal clear in it’s wording.

            At the time of it’s drafting, the militia was every male who could take up arms against an enemy… basically every able bodied male, today (based on the definition of ‘militia’ in Title 10 USC). Arms also meant any weapon or armor that a normal person could carry into battle– so while an RPG or a Kevlar Vest would qualify, a tank, fighter or battleship would not. “The People” references the body of the governed or the citizenry throughout the document. And “well regulated” means/meant (in regards to troops) “disciplined” or “proficient.”

            So, realistically, the 2nd Amendment’s updated verbiage would read:

            “[An armed and proficient] [body of the people], being necessary to the security of a free [Country], the right of the [citizens] to keep and bear [man-portable weapons and armor] shall not be infringed.”

            The only argument to justify placing limitations on gun ownership is if it violates the justification for the constitution, in the first place; laid out in the preamble:

            “We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.”

            So, if your ownership or use of a weapon jeopardizes domestic tranquility, is counter-productive to the common defense, or is detrimental to the general welfare, then it can reasonably be excluded from the cover of the 2nd Amendment. An example would be a “suitcase-nuke”, which is a purely offensive weapon and the use of which violates all of the above… and can, therefore, be exempted from the protection of the 2nd Amendment.

            This is in contrast to a fully automatic weapon, which constitutes (and has always constituted) a very small portion of the total gun crimes. They were popular with organized crime, and still are (since they’re criminals, and don’t follow those laws); but that accounted for a very small proportion of gun violence. The rarity of the events contributed to the media reporting, since rare atrocities are more interesting than common ones.

            However, more to the point, automatic weapons are dangerous because people don’t know how to use them. 60 rounds per minute does not equate to 60 KILLS per minute; since it ignores the human factor in the killing-cycle (find target, judge validity of target, aim at target, focus on target, shoot target, determine if you need a follow-up shot, take shot if necessary, and move on to next target). Even an experienced special operator is looking at between 6 and 10 kills per minute.

            Should restrictions exist? Yes. Training restrictions, to ensure you meet the “well regulated” clause. But that’s not what we have… we have a set of arbitrary rules and fees on a set of arbitrary pieces of equipment that prevents us from appropriately exercising rights as set out in the Constitution.

            However, like you said, the SCOTUS ruled on it… and so that’s the law of the land.

        Actually, that’s not entirely true. President Bush started Operation Wide Receiver in 2006 and it ran until 2007. Operation Fast and Furious, while similar, started under President Obama in 2009 and is a completely separate operation.

        Bush started the idea of Gun Walking; but Op Fast and Furious belonged entirely to Obama from start to finish.

      Actually the .223 or 5.56 that the AR15 fires is meant to penetrate a target not inflict massive damage. The reason AR15’s are illegal (in most states) to hunt with is because it is considered a varmint round, meaning it’s to small to kill large game such as deer humanely. “High Powered” is not a phrase I would use to describe an AR15 because it’s not an accurate description of the weapon. Do some research before you speak please.

      Matthew Mann’s response has already dismantled Diane’s comment out of the water. Most violent gun crimes in America are committed with 9mm pistols, not the AR-15. Head to Chicago or Baltimore and you will see what I am talking about. Even better than the AR-15/M-16/M-4 variants, the .50 caliber sniper rifle easily does more damage per round. That thing can shoot through engine blocks and still hit its target (I have seen this first-hand via army buddies, not to mention a slew of videos). For something more common, a 12 gauge shotgun will easily kill someone with a shot to the leg compared to an AR-15 round, which you can still hobble away to safety.

      Not to mention that the M1 Garand weighs in at 9 lbs. and the ammo is more expensive than for the .223 IF (and that’s a big IF) any miscreant decides to use one in a crime. Not to mention that it’s meant as a field battle rifle. I’ve read some stories that GIs didn’t like them when doing house to house searches. But the M1 Carbine was a little different though a bit underpowered compared to the Garand.
      Even the Garand’s replacement (M14) was a heavy weapon and the grunts in Viet Nam (I’ve talked to many) liked the fact that the M16 offered the soldier the opportunity to carry more ammo on a patrol than the .308 NATO round for the M14.
      Actually they are all good weapons when applied properly.

    The whole idea of executive orders which go beyond the simple process of directing executive branch employees to carry out the directive of the executive is pure baloney and must be deemed unconstitutional. No executive order should ever apply to the general populace. The 3 branches of govt. are by necessity equal under the separation of powers dictum of our constitution. Any imbalance of power between the branches should and must be energetically resisted by the other branches lest they become unneeded and/or powerless. Tyranny can only exist where it is allowed to flourish. One must always conquer tyranny if one wants to lead a free life.

    Why is having a background check for someone trying to purchasing a gun appalling to so many people? If you have a clean background, it shouldn’t be a problem. Also, why do you need military weapons? Are those necessary for hunting? No, they ruin the art of the game, skill. Do you need them for any other reason? Shouldn’t… If you need them, maybe you should join the military and learn the proper way to use them and then you can have them to fight for our country if need be. Keep an open mind America. Just because the violence may not have directly affected you or your area, it has affected other people.

      Another retard who doesn’t understand that the 2nd Amendment has nothing to do with hunting, I really do not understand why people have this view that 2A rights are about hunting…. I have almost no desire to hunt, I like firearms because I find the mechanics of them interesting and ballistics a really cool thing. I like an AR-15 over a bolt gun the same way one might like a modern sports car over a horse and buggy….2nd Amendment is to keep a tyrannical government at bay, and that means having equal arms, back in the day a musket was the “AR-15/M4/M16/whatever of the day” so if you want to try and play that card I’m gonna hit you with a preemptive strike there…As for background checks, well we have this thing called the 4th amendment, people think owning a gun is a privilege in the US and that violating ones 4th amendment rights to exercize their 2A rights is okay but its not a privilege its a guaranteed right. AR-15’s and so-called “Assault weapons” account for less than 1% of crime committed with a firearm, any real law enforcement officer that deals with the scum of the earth will tell you how effective gun control is (hint: its not), any sane prosecutor will also be able to tell you how many cases involving firearms involved legally procured firearms (hint: not that many). Also, even though I hate your views I would NEVER limit your constitutional rights including your 1st and 2nd amendment rights, in fact I would fight to the death to make sure you were able to keep those rights.

      I agree with a lot of the responses here so I’d like to add a bit. Easily refuted arguments by self-proclaimed constitutional scholars aside, the Constitution does not merely state that to Keep and Bear Arms is a right. Making this simplistic claim in the face of the myriad of statutes, ratification arguments, and political writings of the day is testimony to the dishonesty, ignorance, and ego of a large segment of the law fraternity, and liberal media. Regardless of the judiciary’s constant dismantling of the Constitution, it is none-the-less a timeless document of explicitly detailed powers, and limitations placed upon both the federal and state governments. Article 1, Section 8, Clause 15 & 16 state
      that it is the good People of this nation that have the exclusive power and duty to keep enemies both foreign and domestic at bay. As they saw it, it was the only thing “necessary to the security of a free state”.

      The Founders had hundreds of statutes and historical documentation to validate the
      understanding to set the power of the ‘Sword’ in the hands of the People. Regardless of the facts of law, Article 1, Section 8, Clause 15 &16 have been corrupted for both political, and monetary gain by the unscrupulous. You cannot destroy a nation designed of popular sovereignty if the People maintain the ‘Sword’, and therefore the ultimate authority to protect all rights, and to prosecute those who violate the oath of office. The most efficient way to destroy a nation is to do so from within, using tools such as the power hungry, corrupt politicians, and tyrannical judges. There are also the “useful idiots”, such as ‘Mothers demand action’ who will always work to subjugate the masses by their insistence on a complete disrespect for not only the law, but also the
      lessons of history; yes tyranny can most assuredly happen here.

      The ink was not dry on the Constitution when the judiciary began dismantling it as predicted by men such as Patrick Henry and Robert Yates. The Constitution can only be changed by the amendment process as defined at Article 5, but the so-called
      experts give way to tyranny by interpreting away the rule to the whim, and often hysterical agenda of the day. You cannot do what the above article proclaims. Lies and distortion appear to be the common agenda of the politician and media.

      To emphasize this, you need only to look at the national guard, and the constitutionally impossible arguments made to supplant the authority of the People. The experts, so-called, will claim that the guard has replaced the Militia. However, there has been no amendment to do so. The guard does not meet the specifics of Clause 16, and it is beyond the power of the congress to remove a function of government, and most importantly that sole authority with the power “to execute the Laws of the Union”. It is akin to one branch doing away with the other branches of government.
      I have not read every state Constitution, but I can say that the vast majority have Militia within, but it has been the agenda of politicians to remove any power of the People to thwart the unethical, and often tyrannical and treasonous acts of “officials”. The most heinous aspect of dismantling Militia was to create an unsafe environment wherein the “useful idiots” would call for more government intervention, and the inevitable tyranny that comes with an overbearing state.

      It is fair to say that government along with the controlled media disdain the fact that the common man has the lawful authority “to alter or to abolish” any form of government when it becomes destructive of the rights of the good People of this nation.
