The bogus criminal sexual conduct with a minor case against conservative Common Cents radio host Josh Kimbrell has finally been dropped only hours after BenSwann.com published an interview with the radio host.

According to GreenvilleOnline,  prosecutors dropped the case against Kimbrell Thursday for due to insufficient evidence.

“It’s been very difficult to live under the criminal charge that carries a life sentence for something you know you didn’t do and that you also feel like was misrepresented by the police,” said Kimbrell to the Greenville (South Carolina) News.

“I’ve had overwhelming support from my friends, family, the community at large, my radio audience, friends that I’ve worked with in the political arena,” he said.

“It’s been really encouraging to see so many people support me and stand with me.”

Thirteenth Circuit Solicitor Walt Wilkins issued this statement: “Upon receiving this case from the Greenville Police Department and completing an investigation spanning almost four months, my office has determined that there is insufficient evidence to prove the elements of this crime beyond a reasonable doubt.”

According to GreenvilleOnline, the Greenville Police took out an arrest warrant Oct. 14 alleging Kimbrell played a game with his son and fondled him at home from shortly after the child was born through last September, according to the warrant.

In an interview with Joshua Cook for BenSwann.com, Kimbrell explained the situation with his son: “When he was 3 weeks old, my then-wife decided to unilaterally just walk out of the marriage and take our son, decided pretty quickly that she wanted to be the parent.

She didn’t want me to have a place in my son’s life.”

“When you go to family court, they set it up to be the epic battle of your life,” he explained that most custody cases are decided using the 80-20 rule — the child’s mother receives 80 percent custody and the father is left with only 20 percent.

“You take two people who are in a tough spot already. You put them in the Crucible, and it brings out the worst,” he said of the proceedings.

And his ex wife’s worst was unfounded fabrications about Kimbrell and his son.

“She thought that she could just win in the family court system by making unsubstantiated accusations and allegations without any evidence,” he said.

At first, it appeared to work. But then the court started to pick up on her plan.

“She started losing ground pretty quickly. I ended up getting a lot more visitation with my child than most fathers get.I ended up at 50-50 custody arrangement,” he said.

That’s when she went back to the sex abuse allegations.

“She decided to help make it stick that she’d get the police involved and shopped jurisdictions,” he explained. She ended up getting the City of Greenville Police Department involved, and that is when they put out the October arrest warrant for Kimbrell.

In a statement issued Thursday, Greenville Police stood by its call to arrest Kimbrell: “We understand that the solicitor’s office has declined to prosecute the case against Josh Kimbrell. However we stand by the fact that probable cause was established to obtain the warrant for Kimbrell’s arrest.”

“There is absolutely no truth whatsoever in that,” he said of the allegations.

“She basically coached my son into performing what she claimed were sex acts against himself and then tried to coerce him into saying that I taught him to do it.”
