Reality Check: Would Trump’s New CIA Director Reinstate Torture Program?

The next director of the CIA might be one of the most controversial picks ever.

Gina Haspel not only helped to oversee the CIA’s torture program, but may have also destroyed evidence in an effort to hide torture techniques. And one CIA whistleblower says Haspel and those around her “tortured for the sake of torture.”

Is this really the person who should run the Central Intelligence Agency?

Let’s give it a Reality Check you won’t get anywhere else.

Gina Haspel is making headlines as the newly nominated director of the Central Intelligence Agency. She’s been chosen to step in for outgoing CIA Director Mike Pompeo, who President Trump chose to become Secretary of State in place of outgoing Rex Tillerson.

Some of those headlines are for her being the first woman nominated to the top CIA post. But others are rightfully questioning her connections to the CIA’s failed torture program.

So who is Haspel?

Well, we know she’s been with the CIA since 1985 and was assigned to the Central European Division.

According to the New York Times, Haspel served “in Turkey and Central Asia, before ascending to station chief in New York, where she was posted when Osama bin Laden was killed and worked closely with the F.B.I. as the agencies combed through files taken from his compound.”

In her career, she’s also headed up the CIA station in London — twice — and served as the acting director of the CIA’s National Clandestine Service in 2013.

But what’s troubling is her role in torture, and destruction of evidence of torture, dating back to 2002.

In October 2002, Haspel was placed in charge of the CIA “black site” prison named “Cat’s Eye” in Thailand. She arrived after Al Qaeda terror suspect Abu Zubaydah was waterboarded and tortured at the cite.

But, under her watch, another Al Qaeda suspect, Abd al-Rahim al-Nashiri, was waterboarded three times.

I’m sure you know what waterboarding is… it’s a torture technique that simulates a drowning sensation.

The CIA doesn’t like the word torture… instead, they call waterboarding one of 13 “enhanced interrogation techniques” used on detainees dating back to 2001.

Former CIA officer John Kiriakou, who blew the whistle on the agency’s torture practices and went to prison for it, knew Haspel personally. Kiriakou had this to say about her in an interview on Democracy Now.

After the “Cat’s Eye” black site was closed in December 2002, Haspel went to work in the CIA’s National Clandestine Service in Washington, D.C under former director Jose Rodriguez.

This is where Haspel’s background becomes even more troubling.

According to the New York Times, Haspel encouraged her bosses at the CIA in 2005 to destroy video recordings of “enhanced interrogation,” including the tapes of Zubaydah’s waterboarding. Her direct boss, the head of the agency’s Counterterrorism Center, ultimately signed the order to feed the 92 tapes into a shredder.

The videotapes were destroyed just as debates heated up around the globe as to whether these techniques were illegal under U.S. and international laws. And yet, no one was charged in the destruction of what may have been evidence of illegal activity.

At the time the public did not know the extent to which these techniques were being used by our government on suspected terrorists. Candidly, we still don’t, but we did get a glimpse of the CIA torture and rendition program, and its failures, in 2014.

Back in 2012, the Senate Committee on Intelligence voted 9-6 to approve a 6,000 page report on a study of the CIA’s Detention and Interrogation Program.

Just 525 pages of the full report have been declassified since December 2014, but it’s enough to show how mismanaged and ineffective the enhanced interrogation or torture program was in protecting Americans.

Ultimately the report found that the CIA’s torture techniques conducted at black sites did not help the agency get the cooperation of detainees or result in any actionable intelligence.

We know from the report that these CIA black sites were hotbeds for torture. Torture, including stress positions to sleep deprivation to waterboarding.

So why would Trump appoint someone with extensive connections to a secret torture program that failed to protect Americans?

Because Trump believes that the torture program wasn’t “tough enough.” He explained on the campaign trail.

And in an interview with CBS News, Trump further explained that he would want waterboarding to be the “minimum” when fighting terrorism.

What you need to know is that President Trump’s effort to bring waterboarding back to the CIA —if it ever actually ended—might backfire, because he’s putting Gina Haspel in the hot seat.

You see, Haspel’s hearing presents the first time the Senate has had an opportunity to question, under oath, someone directly involved in the CIA torture program. But it’s not just the program the public needs to know more about.

It’s the decision to act and then to destroy evidence of those actions that Haspel and others must be held accountable for.

If no illegal acts were committed, why destroy the evidence?

Reality Check here: Among senior officials, Gina Haspel’s acts are likely not the most egregious in the CIA when it comes to torture. In fact, her actions to carry out the CIA’s torture program, and her actions to help hide evidence of that program, again, among senior officials, is likely not unique. What is unique, is that we know about it.

Trump Orders Sessions to Draft Regulations Banning Bump Stocks

“Just a few moments ago I signed a memo directing the attorney general to propose regulations that ban all devices that turn legal weapons into machine guns. I expect that these critical regulations will be finalized, Jeff, very soon,” said President Donald Trump on February 20 at Tuesday’s Public Safety Medal of Valor Awards Ceremony at the White House.

In a memo to U.S. Attorney General Jeff Sessions issued the same day, Trump wrote, “Although the Obama Administration repeatedly concluded that particular bump stock type devices were lawful to purchase and possess, I sought further clarification of the law restricting fully automatic machineguns.”

Trump’s comments were aimed at bump fire stocks, a firearms accessory that uses a semi-automatic weapon’s recoil to accelerate its firing rate closer to that of an automatic weapon at the expense of accuracy. Bump stocks were alleged to have been used by Las Vegas mass shooter Stephen Paddock in his deadly rampage.

The president’s effort to ban bump stocks comes in the form of a reinterpretation of existing law by the executive branch.

Commenting on the victims and families of last Wednesday’s deadly mass shooting in Parkland, Fla., President Trump said, “We cannot imagine the depth of their anguish, but we can pledge the strength of our resolve. And we must to do more to protect our children. We have to do more to protect our children.”

According to CBS News, the Justice Department said in a statement, “The department understands this is a priority for the president and has acted quickly to move through the rulemaking process. We look forward to the results of that process as soon as it is duly completed.”

New regulations of this type first stand for a period of public comment and legal challenges before going into effect.

Bloomberg notes that White House press secretary Sarah Sanders said at a briefing, “Background checks are something that the president is supportive of making more efficient and looking at better ways to improve that process.” Sanders told reporters asking if Trump supports reauthorizing the Clinton-era federal assault weapons ban, “we haven’t closed the door on any front.”

When asked if President Trump would support raising the federal age limit to purchase a semi-automatic rifle like the AR-15 to 21 years of age or older, Sanders said according to CNN, “I think that’s certainly something that’s on the table for us to discuss and that we expect to come up over the next couple of weeks.”

Reality Check: Trump Did Not Make It Easier for Severely Mentally Ill People To Buy Guns

The latest mass shooting at a school in Florida is once again reigniting the debate over gun control and mental health.

But now the media headlines are blaming President Trump because, they say, he signed a bill that actually made it easier for people with severe mental health problems to get guns.

Is that true?

Let’s give it a Reality Check you won’t get anywhere else.

19-year-old Nikolas Cruz, police say, is the man responsible for gunning down at least 17 teenagers at a Florida high school.

We now know much more about Cruz’s background, which include a number of very disturbing reports of police calls to his home.

According to police records obtained first by CNN, police responded to Cruz’s home 39 times over a seven-year period.

Details about the calls to the Broward County Sheriff’s Office have not yet shown if all involved Cruz.

What do we know about the calls police were responding too? According to KTLA, those included calls of a “mentally ill person,” “child/elderly abuse,” “domestic disturbance” and “missing person.”

We also know that, according to the New York Times, “Last fall, a bail bondsman in Mississippi spotted a disturbing comment on his YouTube channel.”

‘Im going to be a professional school shooter.’

“The bondsman, Ben Bennight, took a screenshot and flagged the comment to YouTube.” And he even “left a voicemail message at his local F.B.I. field office alerting it to the comment.”

The name of the person who wrote that comment? Nikolas Cruz.

And there is more. ABC News reports that law enforcement sources say Cruz claimed “he heard voices in his head, giving him instructions” for the attack. And those “voices were described as ‘demons’.”

So to summarize, at this point it appears that Cruz very likely suffered from extreme mental health issues.

And yet, he was able to legally buy a Smith and Wesson M&P 15 .223, according to Peter Forcelli, special agent in charge of the Miami office of the ATF.

According to USA Today, “Federal law allows people age 18 and older to legally purchase long guns, including this kind of weapon. With no criminal record, Cruz cleared an instant background check via the FBI criminal database.”

According to the Gun Control Act of 1968, if somebody is “‘adjudicated mentally defective’ or has been ‘committed to a mental institution’,” he is prohibited from possessing a firearm under federal law.

Cruz had not been flagged by the proper authorities. So what was the response from the media?

That it is President Trump’s fault because, they say, he and the Republican Party have actually made it easier for people with mental health problems to buy assault weapons.

So is that true? Did the GOP pass, and then President Trump sign, a repeal of an Obama-era directive to keep guns out the hands of people with severe mental illness?

No, that’s not actually what happened.

What did happen?

HJ Resolution 40 was signed by President Trump on February 28, 2017, days after his inauguration.

According to the BBC, “It repealed an Obama-era rule that would have affected about 75,000 US citizens who are too mentally ill to handle their own disability benefits.”

The Obama measure covered those of “marked subnormal intelligence, or mental illness, incompetency, condition, or disease.”

“It also ordered the US Social Security Administration, which administers benefits, to add these names to the National Instant Criminal Background Check System.”

And this is what media is jumping all over.

But what they are not telling you is the incredible groundswell of opposition to the this rule from at least 15 mental health organizations, including American Association of People with Disabilities. And even the ACLU led the charge against this measure, saying it was unconstitutional and wrong.

Wrong, because, according to the Seattle Times, about 2.7 million people currently receive disability payments from Social Security for mental health problems. Another 1.5 million have their finances handled by others for a variety of reasons, according to the LA Times.

Those reasons may have nothing to do with mental illness. And they, those 1.5 million people, are who would not be allowed to purchase a gun.

Dr. Marc Rosen, a Yale psychiatrist who studied how veterans with mental health problems managed there money, points out, “Someone can be incapable of managing their funds but not be dangerous, violent or unsafe.”

And the ACLU’s opposition letter rule states:

“We oppose this rule because it advances and reinforces the harmful stereotype that people with mental disabilities, a vast and diverse group of citizens, are violent. There is no data to support a connection between the need for a representative payee to manage one’s Social Security disability benefits and a propensity toward gun violence.”

So what you need to know is that the Obama-era rule allowed one federal agency, the Social Security Administration, to be judge, jury and executioner of whether millions of Americans can purchase guns, based upon whether some else handles their finances.

Meanwhile, a 19-year-old who has the police come to his home 39 times in seven years somehow goes unflagged.

At the 11th hour, Attorney General Jeff Sessions ordered a review of the FBI and DOJ for mishandling tips about Cruz, stating “It is now clear that the warning signs were there and tips to the FBI were missed. We see the tragic consequences of those failures.”

What will result from this investigation remains to be seen. But if legislation is created to protect against people with violent and dangerous mental health conditions buying guns, then it needs to be crafted in a way that actually works.
